Terms of Service
Last updated: 24 October 2026.
Who we are
These terms are the agreement between you and Max Wittal, sole proprietor, DPT. 196/298, 76120 Cha-Am, Phetchaburi, Thailand (“Gigahost”, “we”). Gigahost rents out virtual machines and containers (“instances”) on hosts that the platform runs itself or that independent providers run, through the website gigahost.cloud, the API and the ghost CLI.
The Acceptable Use Policy is part of these terms. The Privacy Policy says what we keep about you and why.
Your account
Your account is a key that you create and keep: whoever holds the account key controls the account and what it pays for. You are responsible for what is done with it. If you lose it, the account is lost: nobody, Gigahost included, can recover it.
You must be 18 or older, or of the age of majority where you live, and able to enter into this agreement.
Each person may receive the GitHub trial credit once. It is for trying the platform: it pays only for use on Gigahost, ends on its date, and is never paid out.
Balance and payment
Gigahost is prepaid. Your account has a balance in US dollars, which you fund with MMX deposits to the platform's deposit address with your account's deposit memo. A deposit is credited at the MMX/USD exchange rate in effect when it is credited, as Funding your account (external site) describes. A payment without your memo cannot be credited to your account until that memo is known to us.
Prices are shown on Capacity, on each offering and in the catalog before you rent, and every charge is billed as Pricing and billing (external site) describes: what is charged, when, and what is held while an instance exists. Charges are taken from your balance; there are no invoices and no stored payment cards.
MMX payments are final: a payment to the deposit address cannot be called back, and the blockchain records it publicly.
When the balance runs out
Gigahost warns you when your balance is projected to run out within 7 days. If your available balance reaches zero, billing of your instances, gateways and ordinary backups stops at once. Each instance is then stopped, an encrypted final recovery backup is made of it where there is room for one, your other backups are deleted, and the instance is deleted. If the balance reaches zero again later, the final recovery backups are deleted too.
Adding funds before that happens keeps your instances and backups. If your balance runs low (external site) gives every step.
Price changes
New prices apply to new rentals at once. A price rise for something you already rent (an instance's monthly or traffic price, its gateway's or its address's price) takes effect no sooner than 90 days after its notice, which the instance's Overview and Notices show with the exact time.
One-time charges, such as the creation fee and a backup's creation and restore, are those shown when you ask for them; a scheduled backup is charged at the prices in force when its run starts. A backup keeps the storage price it was created with.
Refunds
- A creation that fails is refunded automatically, unless you caused the failure, as Refunds of a failed creation (external site) describes.
- The creation fee of an instance that was created, a restore's charge, the host enrollment fee and charges for what you used are not refunded.
- An instance's balance hold returns to your available balance when the instance is deleted.
- Your unused balance is refunded when you close your account. Ask for it by email to legal@ghostrack.io or in a support ticket, and name an MMX address. Before we pay, we confirm that the request comes from the account holder: by a support ticket of the account or a request signed with your account key. We pay in MMX at the exchange rate in effect when it is paid, and we pay the network fee. A balance under $1 is not paid out.
- Trial credit and SLA credits are not paid out.
Right of withdrawal
If you are a consumer in the European Union or the United Kingdom, or another country that gives you this right, you may withdraw from this agreement within 14 days of the day your account is activated, without giving a reason.
To withdraw, tell us with a clear statement, for example by email to legal@ghostrack.io, naming your account. Sending it before the 14 days end is enough. You may use this wording, but you do not have to:
To Max Wittal, DPT. 196/298, 76120 Cha-Am, Phetchaburi, Thailand, legal@ghostrack.io: I withdraw from my contract for the Gigahost service of account (account alias), activated on (date). (Name, date.)
When you activate the account you ask that the service starts at once, so you pay for what you used until you withdraw. We refund the rest of the deposits you paid within 14 days of your notice, as under Refunds; trial credit is not part of what you paid.
Availability and SLA credits
Hosts can fail, and we do not promise that an instance is always available. When a provider's host is down, each affected instance earns an SLA credit at the multiple of the SLA tier it was rented with, as SLA credits (external site) describes. SLA credits pay that provider's later charges and are the remedy for downtime, within the limits of the Liability section.
Your data and backups
You are responsible for your data and for keeping backups of it. Instance disks are not encrypted by the platform and providers have physical access to their hardware, so we recommend encrypting sensitive data inside the instance.
Backups you buy from the platform work as Backups (external site) describes, and we promise no more than it says. A hosted backup can be restored only with your account key. Deleting an instance deletes its disks.
What you are responsible for
You are responsible for everything that runs in your instances and everything they send: the software, the content and the traffic, also when you let others use them. You keep your instances secure, follow the Acceptable Use Policy and the law, and answer abuse reports about your instances.
When we restrict a service
We may stop an instance, limit or block its traffic, or suspend an account, to end a breach of these terms or the Acceptable Use Policy, to comply with a legal order, or to protect the platform, providers or others from harm. We do what is needed to end the problem and no more.
We tell you what we did and why, unless the law or an emergency prevents it; then we tell you as soon as we can. You can contest a restriction by writing to legal@ghostrack.io: we review it and answer you.
Ending the agreement
You may stop at any time: delete your instances and backups, and ask us to close your account at legal@ghostrack.io or in a support ticket. We may end the agreement with 30 days' notice, or at once for a serious breach, such as illegal content, attacks on others or fraud.
When the agreement ends, your unused balance is refunded as under Refunds, except where a court or authority orders otherwise, or where it is needed to cover damage caused by a breach of these terms.
An account has no email address, so we give notices about your account in the account itself where the platform can (its notices or a support ticket), and on this website otherwise.
Liability
- We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever the law does not allow a limit.
- Otherwise our liability is limited to the amounts you paid us in the 12 months before the claim arose.
- We are not liable for the loss of data that a backup kept by you would have prevented.
- Nothing in these terms limits the rights a consumer has by law.
Changes to these terms
We announce changes on this website at least 30 days before they take effect, with the date at the top of this page. If you do not agree, you may close your account before then and have your unused balance refunded as under Refunds. Using the service after the changes take effect means you accept them.
Applicable law and courts
These terms are governed by the law of Thailand. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring a claim in its courts. Otherwise the courts of Thailand decide disputes.
Providers
A provider offers hosts on Gigahost under these terms and the provider rules in the provider documentation (external site).
- A host must pass the enrollment checks, and enrolling it carries the one-time, non-refundable host enrollment fee.
- A provider must not access, copy or inspect renters' instances, disks, memory or traffic beyond what running the host needs.
- A provider sets the prices it earns; renters pay them plus the platform's share. Earnings become available after the hold of each rental's SLA tier and are paid out in MMX, on request, to the provider's payout address, as Payouts (external site) describes.
- A host with renters is retired with at least 7 days' notice to them, as When a provider retires a host (external site) describes. Downtime of a provider's host is credited to its renters from the provider's charges.
- The provider is responsible for its own taxes, power, hardware and network, and for the law that applies where its hosts run.
- We may stop offering a host that breaks these rules or harms renters, as under When we restrict a service.
- Abuse reports about traffic of a renter's instance on a provider's host come to us, and we handle them with the renter: a provider forwards any it receives to abuse@ghostrack.io.
